TERMS AND CONDITIONS

I. SCOPE

Services of our company are exclusively carried out in accordance with these terms and conditions; contrary divergent conditions of the customer are not accepted, unless we have accepted their validity in writing. Activities to fulfill the contract on our part do not count as acceptance of terms of the contract that are divergent from our terms and conditions. When awarding a contract, the customer has understood and accepted the General Terms and Conditions.

II. CONCLUSION OF CONTRACT

Offers made by the E-SERVICE-GROUP.DE are subject to confirmation. We reserve the right to decline any assignments. A contractual relationship is only established after acknowledgement of an order by the E-SERVICE-GROUP.DE by telephone or in writing. For bookings over several days or for longer journey and departure times of the respective Escort lady, we reserve the right to issue the acknowledgement of an order only after an advance payment in the amount of 30% is made.

III. SUBJECT MATTER OF CONTRACT

The contractually set services comprise the personal commitment of the person booked for escort as hostess for business and private purposes. The customer will not demand any legally inadmissible duties from the person booked. Non-compliance on the customer’s side will result in release of the E-SERVICE-GROUP.DE and the procured person from the provision of the agreed service.
For the appointments made, the E-SERVICE-GROUP.DE permits half an hour of grace period to comply with the fixed appointment. If the customer does not appear, the appointment not kept will be charged the customer. In this case, a service provision is not necessary – the claim is used for compensation purposes.

IV. PRICES

The prices agreed are only valid for the respective commitment.
All prices are gross prices.
All costs arising during the service provision (overnight stays in hotels, food, drinks, entrance fees, etc.) are to be paid by the customer.

V. PROCUREMENT SERVICE

The procurement is made in accordance with the agreed appointment. Should the customer notify us of the prevention to appear at the appointment made, the E-SERVICE-GROUP.DE will try to offer the customer a shifting of the appointment free of charge.
The customer’s withdrawal from the contract is possible until 3 days before the agreed appointment. In these cases, a single service charge in the amount of EURO 100,00 becomes due. Further cancellation costs in connection with this contract, like for example for flights, hotels, rental cars etc. are proved by suitable evidence and will be charged additionally. The E-SERVICE-GROUP.DE is also allowed to withdraw from this contract within the period of time stated above.
The customer will be immediately notified of cancellation of appointments (e.g. due to illness) on the E-SERVICE-GROUP's side.
If the customer withdraws from the contract unjustified, or if the customer disapproves of the person booked, the E-SERVICE-GROUP.DE can cancel the service provision at the customer’s expense and demand full payment. The damage and expenses incurred by this plus a service charge in the amount of 50% of the contract value, but at least EURO 100,00, are charged the customer.

VI. PAYMENTS

For bookings for several days or for longer journey and departure times of the respective Escort lady we reserve the right to issue the acknowledgement of an order only after an advance payment in the amount of 30% is made.
All other escort services must be paid in cash personally to the person booked, at the beginning of the service provision.
Further time booked during a service provision (overtime) is calculated in accordance with our fee guidelines and must be paid in cash directly to the person booked.

VII. RESERVATION/RIGHTS/RESPONSIBILITES

The E-SERVICE-GROUP.DE is only obliged to render services if the customer has paid the agreed fee before the start of the appointment.
The E-SERVICE-GROUP.DE is not liable for activities of the person booked who acts completely on her own responsibility vis a vis the customer and is not an auxiliary person of the E-SERVICE-GROUP.DE. The E-SERVICE-GROUP.DE does not assume liability for the quality of the service.
The customer must state the intended, concrete purpose, the scope and the particulars of the desired performance to the E-SERVICE-GROUP.DE and subsequently to the person booked.
The customer further sees to the fact that the person booked is not endangered in her physical integrity or in regard to her property within the context of the service provision.
For any material or immaterial damage which are incurred to the person booked or to the E-SERVICE-GROUP.DE from the service provision to the customer and which are not in the responsibility scope of the E-SERVICE-GROUP.DE or the person booked.
The customer has to see that the person booked is brought back at the end of the appointment to the place of the initial meeting at the customer’s expense.

VIII. FINAL PROVISIONS

For all agreements, German law applies. Place of jurisdiction for any disputes arising here under is Hamburg.
The customer obliges to book any persons procured through the E-SERVICE-GROUP.DE only via the E-SERVICE-GROUP.DE and never contact them directly or book them via third parties, also in the future.
The customer is not entitled to transfer any claims from this contract to third parties.
All data communicated to the E-SERVICE-GROUP.DE are treated strictly confidential and will not be transmitted to third parties.

IX. SEVERABILITY CLAUSE

If individual articles of these General Terms and Conditions including this article become partly or wholly invalid, or if these conditions contain a gap, the validity of the other articles remains in force. In place of the invalid or missing articles, the respective statutory regulations become effective or, if not available, regulations which are in the sense of the invalid articles.

Copyright and related rights:

All parts of our website are copyrighted and must not be reproduced or transmitted in any form. A commercial application is only allowed after consulting with the author. Any generation, distribution and adaptation (modified, broadened, reduced and translated versions) needs also a written or confirmed agreement of the author.

Any violation of the copyright is punished by civil or penal actions.
